These Terms and Conditions of Sale (“Terms”) apply to purchases made through Watercolor Affair, including the Watercolor Masterclass for Beginners.

By purchasing the Masterclass, you agree to these Terms.

Throughout these Terms, “Watercolor Affair”, “we”, “us” and “our” refer to the company above.

2. Our online courses

Watercolor Affair offers a range of online watercolor courses, including the Watercolor Masterclass for Beginners and smaller, individual courses.

Each course consists of online lessons and associated learning materials designed to help you develop your watercolor skills.

The specific content included in a course, its price, and the access arrangements will be described on the relevant sales page at the time of purchase.

Unless otherwise stated on the relevant sales page, courses provide access to their content for the period stated at the time of purchase. Where a course is described as providing lifetime access, this means access for as long as the course continues to be offered by Watercolor Affair, subject to these Terms.

Your access to a course is personal to you and must not be shared with another person.

We may occasionally update, improve, replace or reorganize course materials. These changes will not remove the essential value of the course you purchased.

3. How your purchase works

When you place an order through our checkout, you are making a purchase of the Masterclass under these Terms.

Before completing your purchase, you will be shown the applicable price and payment option.

Your order is accepted when payment has been successfully processed and we provide confirmation of your purchase.

You will then receive instructions for accessing your Watercolor Affair account and the Masterclass.

4. Prices and taxes

The price you pay is the price displayed at checkout.

Where applicable, VAT or other taxes are included in the displayed price or added at checkout in accordance with the applicable tax rules.

We reserve the right to change the price of the Masterclass for future purchases. A price change will not affect an order that you have already completed.

5. Payment options and installment payments

Where an installment payment option is offered, the installment plan is a payment arrangement for the purchase price shown at checkout.

By choosing an installment plan, you agree to make all scheduled payments according to the payment schedule shown when you purchase.

Installments are processed automatically using the payment method you provide through our payment provider.

The installment option does not constitute a monthly membership or subscription that can simply be cancelled after one or more payments. It is an agreement to pay the stated purchase price according to the agreed payment schedule.

Failed payments

If a scheduled payment fails, we will normally notify you and give you an opportunity to resolve the payment problem.

You may need to update your payment details or contact us if you need assistance.

If a payment remains unpaid, we may temporarily suspend your access to the Masterclass or other courses until the payment issue has been resolved.

Once the outstanding payment issue has been resolved, we will restore your access to the Masterclass.

6. Your account and access

You are responsible for keeping your account login details secure.

You must not share your login details or allow another person to use your account.

If we have reasonable grounds to believe that an account is being shared or used in a way that breaches these Terms, we may temporarily suspend access while we investigate the situation.

We will not normally suspend access for this reason without first contacting you, unless immediate action is reasonably necessary.

7. Right of withdrawal

If you are a consumer, you generally have a statutory 14-day right to withdraw from a distance purchase without giving a reason.

If you wish to exercise this right, please contact us at [email protected] and clearly state that you wish to withdraw from your purchase.

Where applicable, we will process your withdrawal and refund in accordance with applicable consumer law.

Nothing in these Terms limits or removes any statutory consumer rights that apply to you.

8. Our 30-day money-back guarantee

In addition to your statutory consumer rights, we offer a 30-day money-back guarantee for courses to which this guarantee applies.

This is a voluntary guarantee provided by Watercolor Affair and is separate from your statutory right of withdrawal.

If, within 30 days of your purchase, you decide that the course is not right for you, you can contact us at [email protected] and request a refund. You do not need to give a reason.

If you purchased using an installment payment plan, we will refund the payments you have made and cancel any remaining scheduled payments, where applicable.

This 30-day guarantee does not replace, restrict or limit any statutory consumer rights or legal guarantees that apply to your purchase.

9. Digital content and technical requirements

The Masterclass is delivered online. You therefore need a suitable internet connection and a compatible device and web browser.

We cannot guarantee that the Masterclass will work with every device, browser, internet connection or third-party service.

We will make reasonable efforts to keep the Masterclass available and functioning properly, but temporary interruptions may occasionally occur because of maintenance, technical problems or circumstances outside our reasonable control.

10. Intellectual property

All videos, lessons, written materials, illustrations, photographs, demonstrations and other content provided as part of the Masterclass belong to Watercolor Affair or are used with permission.

Your purchase gives you a personal, non-transferable right to access and use the Masterclass for your own learning.

You must not copy, reproduce, republish, redistribute, sell, sublicense or commercially exploit the course materials, whether in whole or in part.

You may, of course, use the watercolor techniques and knowledge you learn from the Masterclass in your own artwork.

11. Student artwork

You retain ownership of artwork that you create while following the Masterclass.

If you voluntarily send artwork to us for feedback or discussion, you retain ownership of that artwork.

We will not sell or commercially exploit your artwork without your permission.

12. Legal guarantees

Nothing in these Terms excludes or limits any statutory consumer guarantees or rights that cannot legally be excluded.

Digital content and digital services supplied to consumers are subject to the applicable legal guarantees of conformity and other mandatory consumer protections.

Where the Masterclass does not conform to applicable legal requirements, you may have rights to request that the problem be remedied or to exercise other remedies provided by law.

If you have a problem with your purchase, access to the Masterclass or the service we provide, please contact us first:

We will make reasonable efforts to resolve the issue directly with you.

14. Consumer mediation

If you are a consumer and we are unable to resolve a dispute after you have made a written complaint to us, you may be entitled to use a consumer mediation service.

The consumer may only refer the dispute to the mediator after first making a written complaint to us, in accordance with the applicable mediation rules. Consumer mediation is generally free of charge for the consumer.

15. Limitation of liability

We provide the Masterclass as an educational resource to help you develop your watercolor skills.

We do not guarantee any particular artistic result. Your results will depend on factors including your practice, experience, materials and the amount of time you devote to painting.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

16. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or our services.

The version that applies to your purchase is the version in force when you place your order, unless a later change is required by law to apply to an existing contract.

17. Applicable law

These Terms are governed by French law, except where mandatory consumer protection laws in your country of residence provide you with additional rights that cannot legally be excluded.

Nothing in these Terms prevents a consumer from exercising rights provided by the mandatory laws applicable to them.
